Terms of Use — OwlCarTT

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under the laws of Trinidad and Tobago to create an account or post a listing. Browsing listings does not require an account or agreement to these Terms, but posting, contacting a seller, or managing listings does.

Each person may hold only one account. Creating additional accounts to work around the listing limit described in Section 5, to evade a suspension, or to otherwise circumvent these Terms is prohibited.

2. What OwlCarTT Is — and Is Not

OwlCarTT is a listing platform. It gives sellers a place to post vehicles and gives buyers a way to browse and contact sellers directly. That is the extent of our role.

We are not a party to any sale, purchase, or rental. Every transaction is strictly between the buyer and the seller. We do not broker, negotiate, inspect, appraise, title-check, finance, insure, or process payment for any vehicle.
We do not verify that a seller owns the vehicle they've listed, that the information in a listing is accurate, or that a buyer is who they claim to be. Beyond the basic account and posting requirements in these Terms, verification is not something the App performs.
All payment and exchange of the vehicle happens off-platform, arranged directly between buyer and seller. OwlCarTT has no payment processing, escrow, or delivery function of any kind.
Contacting a seller through the App (including the WhatsApp button on a listing) starts a conversation between you and that individual — nothing said or agreed there is reviewed, stored, or guaranteed by us.

Meeting a stranger to view or exchange a vehicle carries real personal-safety and fraud risk. Meet in a safe, public location, bring another person if possible, verify ownership documents before paying anything, and never wire money or pay in full before seeing the vehicle in person. OwlCarTT is not responsible for what happens at an in-person meeting arranged through a listing.

3. Your Account

You need an account to post a listing, contact a seller, or manage your ads. You sign in with Google or Facebook — there is no separate email/password option.
Before your first listing, you'll complete a one-time profile with your name and phone number — this is what appears to buyers who open your listing's contact details.
You're responsible for keeping your account secure and for everything that happens under it. Tell us right away if you believe your account has been compromised.
The information in your account and profile must be accurate. You may update your profile at any time, and changes apply immediately to all of your listings.

4. Posting a Listing

When you post a vehicle ad, you're responsible for everything in it. By posting, you confirm that:

You own the vehicle, or you are authorized by the owner to list it for sale or rent.
The photos, description, price, mileage, and every other detail are accurate and not misleading to the best of your knowledge, and reflect the vehicle's actual current condition.
You have the right to use every photo you upload (they're either your own or you have permission to use them), and they actually depict the vehicle being listed.
The vehicle is legally yours to sell or rent — not stolen, not subject to an undisclosed lien that would prevent the sale, and not otherwise unlawful to list.
The listing is for a real vehicle actually available for sale or rent — not a placeholder, a duplicate of another listing, bait to drive traffic elsewhere, or any other form of spam.
The listing is for an actual vehicle in one of the categories the App supports (car, truck, heavy vehicle, or motorcycle) — nothing else. OwlCarTT is a vehicle classifieds app, not a general marketplace. Parts, accessories, unrelated goods or services, and anything that isn't itself a vehicle for sale or rent have no place in a listing.

The photo tool that blurs a license plate is provided for your convenience, but redacting any information in your photos — plates, documents, faces, or anything else — is your responsibility. We don't review photos before they're posted.

We may remove a listing, or suspend or terminate an account, at our discretion if we believe it violates these Terms — including for fraudulent, misleading, duplicate, or prohibited listings — without a duty to notify you in advance, though we'll generally try to explain why if asked.

5. Listing Limits, Expiry, and Relisting

Free accounts may have up to 3 active (non-expired) listings at a time. This limit is enforced by the App itself, not just described in these Terms — you can't post a fourth active listing until one of your existing ones expires, is deleted, or is relisted over.
A listing automatically expires 30 days after it's posted (or after it's relisted). An expired listing is removed from public Browse but stays visible to you under "My Ads," where you can relist it to start a new 30-day period.
A listing that stays expired for a further 60 days without being relisted is permanently deleted, along with its photos.
We may introduce a paid tier in the future (for example, raising the listing limit for dealers). Nothing in these Terms should be read as a promise that the current free limits, or the availability of any feature, will remain unchanged.

6. "VIP" Listing Style

You can optionally mark your own listing with a "VIP" visual style (a highlighted border and badge) at no cost. This is a self-selected cosmetic option, not a paid placement, and does not currently affect a listing's position, ranking, or visibility in Browse or search results. We may change, limit, or discontinue this feature, or introduce a paid version of it, at any time.

7. Prohibited Conduct

In addition to the listing rules in Section 4, you agree not to:

Use the App for any unlawful purpose, or to list anything you don't have the legal right to sell or rent.
Post a listing, photo, description, profile, or any other content that isn't genuinely about a vehicle for sale or rent — including unrelated items or services, sexually explicit or pornographic material, or any other content with no legitimate connection to vehicle classifieds.
Harass, threaten, defraud, or attempt to deceive another user.
Impersonate any person or misrepresent your affiliation with any person or organization.
Scrape, bulk-download, or systematically extract listings, contact information, or any other data from the App outside of normal, individual use.
Attempt to bypass, disable, or interfere with any security feature, rate limit, or access control of the App.
Reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent applicable law expressly permits it despite this restriction.
Upload any virus, malware, or other harmful code, or any content that infringes someone else's intellectual property or violates their privacy.
Use another user's contact information (obtained through a listing) for any purpose other than discussing that specific listing — including unsolicited marketing.

8. Your Content and Our License to Use It

You retain ownership of everything you post — photos, descriptions, and any other content. By posting it, you grant OwlCarTT a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and promoting the App (for example, showing your listing to other users in Browse, in listing detail pages, and in push notifications for matching saved searches).

This license ends when you delete the content or your account, except for copies that persist briefly in backups or caches until they're naturally cleared, and except where we're required to retain something for legal, security, or fraud-prevention purposes as described in our Privacy Policy.

If you believe content on OwlCarTT infringes your intellectual property rights, contact us using the details in Section 18 with enough information for us to locate and evaluate the content.

9. Third-Party Services

The App relies on third-party services to operate — including Google and Facebook (sign-in), Supabase (backend and storage), Expo/EAS (app updates and push relay), and WhatsApp (if you use the in-app contact button). Your use of those services through the App is also subject to their own terms. We aren't responsible for the availability, content, or practices of any third-party service.

10. Intellectual Property

The App itself — its design, branding, logo, and underlying software — is owned by OwlCarTT or its licensors and is protected by applicable intellectual property law. Nothing in these Terms grants you any right to use OwlCarTT's name, branding, or software except as necessary to use the App as intended.

11. Termination

You may stop using the App and delete your account at any time. Deleting your account removes your listings and profile information as described in our Privacy Policy.

We may suspend or terminate your account, with or without notice, if we reasonably believe you've violated these Terms, created risk or legal exposure for us or another user, or if we're required to do so by law. Sections of these Terms that by their nature should survive termination (including Sections 2, 8 as to already-granted licenses, 12, 13, 14, and 15) will continue to apply after your account is terminated.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING IS ACCURATE, COMPLETE, OR THAT ANY VEHICLE DESCRIBED IN A LISTING IS AS DESCRIBED. YOU USE THE APP, AND YOU ENGAGE WITH ANY OTHER USER, ENTIRELY AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OWLCARTT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP — INCLUDING, WITHOUT LIMITATION, ANY DISPUTE, TRANSACTION, MEETING, OR COMMUNICATION BETWEEN YOU AND ANOTHER USER, ANY INACCURACY IN A LISTING, OR ANY LOSS ARISING FROM A VEHICLE'S CONDITION, TITLE, OR LEGALITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED ONE HUNDRED TRINIDAD AND TOBAGO DOLLARS (TT$100.00), SINCE THE APP IS PROVIDED FREE OF CHARGE.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Trinidad and Tobago.

14. Indemnification

You agree to indemnify and hold OwlCarTT and its operators harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your listings or other content; your violation of these Terms; your violation of any law or of any third party's rights; or any transaction, meeting, or dispute between you and another user.

15. Governing Law and Disputes

These Terms are governed by the laws of Trinidad and Tobago. Any dispute arising from these Terms or your use of the App is subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

16. Changes to These Terms

We may update these Terms as the App changes. We'll update the "Last updated" date above when we do, and for material changes, we'll provide more prominent notice (such as an in-app message). Continuing to use the App after a change takes effect means you accept the revised Terms.

17. General

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and OwlCarTT regarding your use of the App, and supersede any prior agreement on the subject.
Severability. If any provision of these Terms is found unenforceable, the rest remain in full effect, and the unenforceable provision will be interpreted to best reflect its original intent within the limits of the law.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign these Terms or your account to anyone else. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
